1. Scope

These General Terms and Conditions (GTC) apply to all deliveries from KUK GmbH (hereinafter KUK Shop) to consumers. You are a consumer if you are a natural person who concludes a legal transaction for a purpose that cannot primarily be attributed to your commercial or self-employed professional activity..

2. Contractual partner

The purchase contract is concluded with KUK GmbH, Kolberger Straße 1, 40599 Düsseldorf, commercial register: HRB 22904 District Court of Düsseldorf.

3. Conclusion of contract

3.1. The presentation of the products in the online shop does not constitute a legally binding offer, but rather only an invitation to order. 3.2. Your purchase contract is concluded when we accept your order by sending an order confirmation via email immediately after receiving your order.

4. Right of withdrawal

4.1. If you are a consumer (i.e. a natural person who places the order for a purpose that cannot be attributed to your commercial or independent professional activity), you have a right of withdrawal in accordance with the statutory provisions.
4.2. If you as a consumer exercise your right of withdrawal in accordance with Section 4.1, you will have to bear the regular return shipping costs.
4.3. Otherwise, the regulations that are set out in detail in the following cancellation policy apply to the right of cancellation.

Right of withdrawal
You have the right to cancel this contract within fourteen days without giving any reasons.
The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the goods.

If you make use of this option, we will immediately send you confirmation (e.g. by email) of receipt of such a revocation.
In order to meet the cancellation period, it is sufficient that you send the notification of your exercise of the right of cancellation before the cancellation period has expired.

Consequences of revocation
If you cancel this contract, we will have to pay you all payments we have received from you, including delivery costs (except for additional costs resulting from you choosing a method of delivery other than the cheapest standard delivery offered by us have) to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract. For this repayment we use the same payment method that you used for the original transaction, unless something different was expressly agreed with you; under no circumstances will you be charged any fees as a result of this repayment. 5. Prices and shipping costs

5.1. The prices stated on the product pages include statutory VAT and other price components.
5.2. In addition to the prices stated, we charge a flat rate of 8.90 euros per box for delivery within Germany. The shipping costs will be clearly communicated to you on the product pages, in the shopping cart system and on the order page.

6. Delivery

6.1. Delivery only takes place within Germany with UPS.
6.2. The delivery time is up to 3 days. We will point out any different delivery times on the respective product page.

7. Payment

7.1. Payment can be made either in advance, credit card, Paypal or Giropay/EPS.
7.2. If you choose the advance payment method, we will give you our bank details in the order confirmation and deliver the goods after receipt of payment.

8. Retention of title

The goods remain our property until full payment has been made.

9. Warranty for material defects

KUK Shop is liable for material defects in accordance with the applicable legal regulations, in particular Sections 434 ff of the German Civil Code.

10. Dispute Resolution

The EU Commission has created an internet platform for online dispute resolution. The platform serves as a contact point for the out-of-court settlement of disputes regarding contractual obligations arising from online sales contracts. Further information is available at the following link: http://ec.europa.eu/consumers/odr. We are neither willing nor obliged to take part in a dispute resolution procedure before a consumer arbitration board.
